These Terms of Service ("Terms") govern your access to and use of the HgBest API ("API Services") provided by Haven Group Tech Ltd ("we," "us," or "our"), a company registered in England and Wales (Company No. 17179874). By accessing or using the API Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the API Services.
1. Acceptance of Terms
By registering for an account, generating an API Key, or accessing the API Services, you confirm that you have read, understood, and agreed to these Terms. If using the API Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. API Keys and Account Security
- API Keys: You must obtain an API Key and API Secret to access the API Services. You agree to keep these credentials strictly confidential. You are solely responsible for all activity under your API Key.
- Account Information: You agree to provide accurate, complete, and current registration information and to keep it updated.
- Unauthorised Use: You must notify us immediately at info@hgbest.online of any unauthorised use of your API Key or any suspected security breach.
Never expose your API Secret in client-side code. Always sign requests server-side. We are not liable for losses resulting from compromised credentials.
3. Permitted Use and Restrictions
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the API Services for lawful development and integration purposes.
You agree not to:
- Use the API Services for any unlawful, harmful, fraudulent, or abusive purpose
- Reverse engineer, decompile, or disassemble any part of the API Services
- Attempt to gain unauthorised access to any system connected to the API Services
- Use the API Services to build a directly competing product
- Submit fraudulent, fabricated, or unlawfully obtained identity documents to the AML/KYC endpoint
- Interfere with or degrade the performance of the API Services
- Remove or obscure any proprietary notices in the API Services
4. AML/KYC Endpoint — Special Terms
The /aml-kyc/verify endpoint processes identity documents and biometric data. By using this endpoint, you additionally agree that:
- You have obtained all necessary consents from individuals whose data you submit for verification
- You will comply with all applicable data protection, AML, and KYC laws in your jurisdiction
- You will not submit documents belonging to individuals without their explicit informed consent
- Our zero-retention policy means images are never stored — you are solely responsible for maintaining your own compliance records
- Our verification results are AI-assisted and indicative only — final compliance decisions remain your responsibility
5. Data and Privacy
- Your Data: You retain all rights to data you submit. You grant us a limited licence to process it solely to provide the API Services.
- API Output: Verification results and API responses are owned by Haven Group Tech Ltd. You are granted a licence to use them within your applications.
- Privacy Policy: Data handling is governed by our Privacy Policy, which forms part of these Terms.
6. Fees and Payments
- Pricing: Plan details, limits, and pricing are displayed in the developer dashboard and are subject to change with reasonable notice.
- Billing: All payments are processed by Stripe. By subscribing, you authorise recurring charges on your chosen billing cycle.
- No Refunds: All fees are non-refundable unless otherwise agreed in writing by Haven Group Tech Ltd.
- Usage Limits: If you exceed your plan limits, access will be restricted until the next billing cycle or until you upgrade.
7. Modifications
- Terms: We may modify these Terms at any time. Material changes will be communicated via email or dashboard notification. Continued use after changes constitutes acceptance.
- API Services: We reserve the right to modify, suspend, or discontinue any part of the API Services with or without notice. We will not be liable for any such changes.
8. Termination
- By You: You may terminate your account at any time by ceasing use and contacting us.
- By Us: We may terminate your access immediately and without notice for breach of these Terms, harmful use, non-payment, or at our discretion.
- Effect: On termination, your right to use the API Services ceases immediately. Provisions that by nature should survive termination will do so.
9. Disclaimer of Warranties
The API Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the API Services will be uninterrupted, error-free, or suitable for your specific purposes. AML/KYC verification results are AI-assisted and do not constitute legal compliance advice.
10. Limitation of Liability
To the fullest extent permitted by law, Haven Group Tech Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or business — arising from your use of or inability to use the API Services, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless Haven Group Tech Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, or costs (including legal fees) arising from your use of the API Services or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
